“As the dust from the Civil Justice reforms begins to settle, it appears that Parliamentary counsel have slipped another consultation through in the background. Published in March this year, it appears innocuous enough, but on further consideration raises a number of significant concerns. I also question why this report was even necessary. Parliamentary austerity and wholesale changes to the legal profession should have lent caution to the writers of the report, given that this can be construed as a real attack upon the legal profession. Ill-timed and badly thought out, the principle will be applauded by businesses that will look at the superficial benefits but not appreciate the issues, and is therefore convenient politically.”

“I’ve been following the Parliamentary Counsel’s laudable ‘good law’ initiative with interest (details on the Cabinet Office site here). The aim of the initiative is to have law that is #necessary, clear, coherent, effective and accessible’. The focus, perhaps naturally for the OPC, is on the complexity and drafting of legislation. Their document ‘When laws become too complex’ is well worth a read for anyone who regularly deals with legislation.The first thing that strikes me is that this initiative is really about good legislation rather than good law since case law doesn’t get much of a mention. But, for the sake of argument, let’s agree that good legislation gets us half way to good law and is worth our consideration.”

The New World of Whistleblowing: bringing back the public interest – 11 KBW

“The enactment of the Public Interest Disclosure Act 1998 (“PIDA”) was designed to introduce important protection for those blowing the whistle to draw attention to wrongdoing discovered in the workplace. During the passage of the Bill in the House of Lords, Lord Nolan commended those behind it ‘for so skilfully achieving the essential but delicate balance in this measure between the public interest and the interests of employers’. Fifteen years on, the verdict is less effusive. Significant gaps had been identified in the legislation, for example in failing to impose vicarious liability on employers for acts of victimisation carried out by their employees or agents. In other respects, however, PIDA has come to be seen a blunt instrument, enabling disgruntled employees to seek unlimited compensation despite having done nothing to further the public interest.”
