‘The presentation will compare the statutory general anti-avoidance rules in Australia, New Zealand and Canada. It will discuss the major cases and the issues raised by both the Revenue and taxpayers in applying the general anti-avoidance rule. In particular, it will examine the difference in the legislative and judicial approach to tax avoidance, and highlight the ebb and flow of the attitude to alleged tax avoidance arrangements in each jurisdiction. This will consider “how taxpayers can know when they cross an invisible line” and what powers the revenue authorities have in combating arrangements ultimately found to be tax avoidance.’

‘Major changes in financial crime and AML compliance lie ahead in the coming years. The 4th EU Money Laundering Directive and resultant update of the UK regulations will have a significant impact on the legal profession. Solicitors will also need to be ready to deal with new domestic rules on ultimate beneficial ownership information and new orgfanised crime offences. Compliance activities will come under scrutiny in the SRA thematic review of AML systems and the forthcoming FAFT Mutual Evaluation Review of the effectiveness of the UK’s AML regime. All of these developments will have substantial implications for solicitors and the way they conduct their business.’

‘This paper discusses key elements of an empirical socio-legal research project which analyses the legal regulation of water resources in the UK. Climate change is associated with increasingly severe weather events, that give rise to alternating periods of flooding and drought, with these being significant also in the UK, as witnessed during the winter 2013/4 floods and the 2010-12 drought, which affected in particular the South-East of England.’

“This year’s DLA conference “Discrimination and Economic Inequality: two faces of disadvantage” confronts the duality of hardship which increasingly is the reality for far too many people. The critical question: Can you tackle one without the other? will be considered by speakers and in discussions throughout the day. For equality lawyers, advisers and activists, trade unionists and equality officers, this conference offers a unique opportunity to bring together ideas and experience relating to this issue.
Our two keynote speakers, Sarah Veale, Head of Equality and Employment Rights at the TUC and Colm O’Cinneide, Reader in Law, UCL, will consider from their different perspectives what is needed to overcome both discrimination and economic inequality.
Our outstanding line-up of plenary speakers – Karon Monaghan QC, Robin Allen QC and Stephanie Harrison QC will review where we are now in terms of law and policies that impact on equality. Their sessions will cover developments in UK equality law, recent relevant decisions of the European courts and the equality impact of restrictions imposed under immigration legislation.
As in previous years, during the afternoon participants will be able to choose topics they wish to explore in greater depth during breakout sessions covering a range of current equality law issues. The breakout sessions, led by experienced lawyers with specialist expertise, will provide practical advice in relation to particular areas of law or procedures.
A panel, chaired by Robin Allen QC, reflecting different interest groups within society, will bring the conference back to its main theme – discrimination and economic inequality – and the question “Can you tackle one without the other?”.

‘A landmark ruling of the European Union Court of Justice, in May of this year, held that it is Google’s responsibility to remove outdated or ‘irrelevant’ search results hosted by third parties. EU justice commissioner Viviane Reading praised the decision, hailing a “clear victory for the protection of personal data of Europeans”, while others have raised concerns over its implementation, fearing that it could mark a slippery slope toward online censorship.’

‘It is trite that recent decades have seen an explosion in levels of senior executive remuneration in public companies, both absolutely and relative to ordinary worker pay. A conspicuous corresponding trend over recent years, though, has been the development of a range of countervailing regulatory tools designed to mitigate this disparity within various national environments. These include regulatory pay ratio caps, bonus bans, and mandatory pay ratio disclosures. Notwithstanding these salient developments, prevailing legal and economic debates on executive and worker pay remain rooted in the dominant principal-agent paradigm of corporate governance, which consistently disputes the relevance of equitable or distributive fairness concerns to the essentially functional challenge of determining effective agent incentives. In this lecture I will take issue with the orthodox principal-agent perspective on pay equity, by demonstrating the centrality of equitable concerns to effective agent-incentive design, both at senior executive and ordinary worker levels.’

‘Legislation has the limited object of changing the law. So it consists of abstract rules of general application which appeal to the intellect. Other forms of writing can summon up mental pictures of individual people and events and appeal to the emotions. Another consequence of its limited object is that every word of an Act counts and its language is spare. Techniques available to other writers (like repetition and exuberance) are generally denied to the drafter. So drafting is unlikely to produce literature. The fascination lies in producing something precise and clear while operating within the inherent restraints.’
