‘With Professor David Ormerod, Barrister (Bencher of Middle Temple).

David Ormerod was appointed Law Commissioner for Criminal Law and Evidence on the 1 September 2010 and is on secondment from Queen Mary until 2015.
He is Professor of Criminal Justice at Queen Mary, University of London. He is the author of numerous journal articles and book chapters, and several hundred case commentaries.
The lecture will be followd by a reception.’

‘2015 marks the 800th anniversary of the sealing of the Magna Carta. The values enshrined in the Magna Carta remain as valuable today as they have ever been. Justice, fairness, equality and legitimacy remain central to a strong, democratic legal system. They are lasting values, which will remain as relevant to lawyers today as they will for the next 800 years and beyond.

To celebrate the anniversary, Lord Dyson, the Master of the Rolls will be giving a presentation at the Law Society entitled “Delay too often defeats justice”.’

‘The Public Interest Disclosure Act 1998 is currently subject to a Government Consultation. Sections 17-20 of the Enterprise and Regulatory Reform Act 2013 have introduced a series of changes. Meanwhile, the European Ombudsman has asked “what are the EU Institutions doing to protect whistleblowers?” We ask whether whistleblowing legislation is working here and in Europe and what more needs to be done to encourage, support and protect those who disclose information in the public interest.’

‘The reformulated duty of loyalty now found in section 172 of the Companies Act 2006 has generated debate about what is the best reading of the duty, the most fundamental aspect of which is whether this behavioural standard obliges a narrow focus on financial capital or a broader notion of well-being and inclusiveness amongst non-shareholder interests. This research argues that the law as a privileged and constitutive way of society-making can only be understood within a broader conceptual framework rather than the more traditional expository analysis of law. The context in which such an analysis takes place is that of the anti-collectivist, market-based political project of neoliberalsm. When viewed through this explanatory lens we see very clearly that English legal doctrine entrenches a relationship between managers and shareholders. In doing so the research shows that the extraction of private benefits of control by shareholders is not an inevitable occurrence, but a decades-long, human created, and contingent phenomena. While non-shareholder language is introduced into the duty, this precatory element is merely a potential source of legitimacy to the ideology of the company as a private, exclusively shareholder-oriented enterprise.’

Advocates of labour rights argue that constitutional protection of the freedom of association should be interpreted to include the rights to bargain collectively and to strike. They invoke international and transnational human rights instruments, as well as the observations of the International Labour Organization’s supervisory bodies, as normative resources that can be used by constitutional courts to advance such an interpretation.

‘Jeff McMahan is White’s Professor of Moral Philosophy at the University of Oxford. He completed a BA degree in English literature at the University of the South (Sewanee), followed by graduate work in philosophy at Corpus Christi College, Oxford as a Rhodes Scholar. Professor McMahan then studied at the University of Cambridge, where he was a research fellow of St. John’s College from 1983 to 1986 and received his doctorate in 1986. He has written extensively on normative and applied ethics. His publications include The Ethics of Killing: Problems at the Margins of Life (Oxford University Press, 2002), Killing in War (OUP, 2009), which argues against foundational elements of the traditional theory of the just war, The Morality of Nationalism (co-edited with Robert McKim, OUP, 1997), and Ethics and Humanity (co-edited with Ann Davis and Richard Keshen, OUP, 2010).’

‘Dr. Meckled-Garcia is the founder of the Human Rights programme at the School of Public Policy, having designed and launched the MA in Human Rights in 2003. He is also co-founder and Director of the new UCL Institute for Human Rights. His research focuses on the ethical foundations of human rights, and on theories of international justice. ‘The Origins of Modern Financial Crime: Historical foundations and current problems in Britain (Abingdon: Routledge, 2014) provides a multi-disciplinary analysis of ‘the problem’ of financial crime in the ‘commercial sphere’ in Britain. It reflects the longstanding view that the challenges presented by financial crime, which are both enforcement and perceptually oriented, as they are understood by academic scholars and also practitioners and regulators and policymakers, merit an analysis drawing on contributions from many academic disciplines. In drawing extensively on legal and criminological approaches, the text centrally also highlights the benefits which can emanate from historicising the ‘problem’ of financial crime. And in doing so this analysis of financial crime also constitutes an entreaty for encouraging legal scholarship to engage more comprehensively with historical enquiry and analysis.’
